Charleston, W.Va. – Today the West Virginia Secretary of State’s Office was served with a petition filed by State Senator Donna Boley seeking clarification of candidate eligibility.
The petition asks the court to decide whether Frank Deem is entitled to be on the ballot for State Senate District 3.

"This petition involves a dispute over whether or not a candidate is eligible to be elected and involves conflicting provisions of the West Virginia Constitution and the United States Constitution,” said Secretary of State Natalie E. Tennant. “Obviously the Secretary of State does not decide disputes over the constitution and I am neutral in this suit. The Secretary of State's Office welcomes this petition as an opportunity to resolve the dispute for this and all future elections."
“The Secretary of State is named as respondent because this office notifies the county clerks what candidates are on the ballot. Ballots must be printed and delivered to overseas military and citizens no later than March 23. It takes the ballot printer several weeks to prepare all of the hundreds of different ballot designs, have the designs proofed by the county ballot commissioners, printed and delivered. Therefore, it is urgent that the Court decide this issue quickly.”
