 Step 2 - Find Out Where to File

  File with the County Clerk of the county where the property is located only if the collateral is as-extracted collateral (such as minerals, stone, gas) or timber to be cut.  Once timber is cut it is not secured by this filing and a new filing with the Secretary of State as ordinary goods is required.

  File with the County Clerk of the county where the property is located only, if the financing statement is a fixture filing and the collateral is goods that are or are to become fixtures.  To be a fixture filing, the financing statement must indicate that it is to be filed for record in the real property records.

  File with the Secretary of State only in all other cases, including a case in which the collateral is goods that are or are to become fixtures but the statement is not filed as a fixture filing.
